Terms & Conditions

1. Scope & Provider

These Terms & Conditions apply to all contracts concluded via the website praecis.ch or following a personal qualifying call with LA Horizon GmbH, Breitenstrasse 21, 8852 Altendorf, Switzerland (Business ID CHE-241.291.818), hereinafter “PRAECIS”. They cover (a) the sale of digital products (e-books) and (b) coaching subscriptions (e.g. Core Protocol, Precision Protocol).

Any deviating terms of the customer are not recognised unless PRAECIS expressly agrees to them in writing.

2. Subject Matter

(a) Digital products: the sale of digital content for download (e-books in PDF format). (b) Coaching subscriptions: the provision of individual health and performance coaching as an ongoing, monthly-billed subscription.

For coaching subscriptions, the provisions of the respective coaching agreement apply in addition. In the event of conflict, the individually concluded coaching agreement prevails over these Terms.

3. Conclusion of Contract

The presentation of products and prices does not constitute a legally binding offer but an invitation to order.

Digital products are ordered via the checkout on praecis.ch (payment service provider Stripe); the contract is concluded upon confirmation of the order or provision of the download link. Coaching subscriptions are agreed following a personal qualifying call; the contract is concluded upon acceptance by both parties or upon set-up of the subscription and the first payment.

4. Prices & Payment

All prices are in Swiss francs (CHF) and include any applicable statutory value added tax. Digital products are charged once. Coaching subscriptions are billed monthly in advance (recurring payment via the payment service provider Stripe).

In the event of default, PRAECIS is entitled to suspend the services until payment is received in full. The terms of the respective payment service provider apply in addition.

5. Delivery of Digital Products

After successful payment, the customer receives the ordered e-books as a personalised, time-limited download link by email to the address provided during ordering (usually within a few minutes). For security reasons, the download link is valid for 7 days. No physical goods are delivered.

6. Term, Renewal & Cancellation (Coaching Subscriptions)

Coaching subscriptions (Core Protocol, Precision Protocol) are operated as a monthly-billed subscription. Upon first conclusion of a coaching protocol, a minimum term of three (3) months applies. This period is necessary for the measures to take effect.

After the minimum term expires, the subscription automatically renews by one (1) month at a time. The customer may cancel the subscription in text form (in writing, e.g. by email to info@praecis.ch) with effect to the end of a calendar month, but at the earliest to the end of the three-month minimum term. Cancellation must be declared to PRAECIS.

The right to extraordinary termination for good cause remains unaffected for both parties.

7. Withdrawal & Returns

Under Swiss law, there is no general statutory right of withdrawal or return for online orders.

Digital products: As the content is digital and provided immediately, withdrawal or a refund is excluded once the download link has been provided. By purchasing, the customer expressly agrees that provision begins immediately. For customers resident in the EU, any right of withdrawal for digital content lapses as soon as performance has begun and the customer has expressly consented and acknowledged that they thereby lose their right of withdrawal.

Coaching subscriptions: The provisions on term and cancellation (section 6) apply. There is no further right of withdrawal or refund; amounts already paid for the current billing period or the minimum term are not refunded. Statutory warranty rights in the event of defective performance remain unaffected.

8. Rights of Use & Licence

Upon purchase, the customer receives a simple, non-transferable right to use the e-books as well as any plans, protocols and documents provided during coaching for personal, non-commercial purposes. The e-books are personalised and carry an individual watermark. Any sharing, reproduction, making publicly available or resale – in whole or in part – is prohibited without the prior written consent of PRAECIS.

9. Coaching Services & Medical Notice

The coaching is health and performance consulting and does not constitute or replace medical treatment, diagnosis or therapy. The activity of PRAECIS – including the interpretation of blood values – is an advisory and educational service in the fields of health, nutrition and training and does not constitute a healing activity within the meaning of the applicable health legislation; no prescription-only measures are ordered. The analysis of blood values serves optimisation purposes only and does not replace a medical evaluation. The customer remains responsible for their own health and shall consult a physician in case of complaints. PRAECIS makes no promise of cure or specific results. Details of service provision are governed by the coaching agreement.

10. Warranty & Defects

Should a download fail technically or a file be defective, PRAECIS will re-provide the content or remedy the defect after contact at info@praecis.ch. Further claims are governed by the statutory provisions.

11. Liability

PRAECIS is liable only for damage caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law; personal injury remains unaffected. The content of the e-books and the coaching is for information and advisory purposes, does not replace individual medical treatment, and no warranty is given for any particular result.

12. Data Protection

The processing of personal data is carried out in accordance with our privacy policy.

13. Governing Law & Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules. The exclusive place of jurisdiction is – to the extent permitted by law – the registered seat of LA Horizon GmbH in the Canton of Schwyz, Switzerland.

14. Final Provisions

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected. PRAECIS reserves the right to amend these Terms; the version in force at the time of the order or conclusion is authoritative.
